These Terms of Service ("Terms") form a legally binding agreement between you ("you", "your", or "User") and heystudy regarding your access to and use of our website heystudy.io and related services (collectively, the "Service").By accessing or using the Service through a web browser or any other interface we may provide, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated by reference. Description of Serviceheystudy provides a comprehensive suite of digital productivity and learning tools designed to help individuals organize their studies efficiently. Its core functionalities include note-taking, mind mapping, pomodoro time management, AI-assisted quizzes and flashcards, and calendar-based scheduling. We may update, enhance, or discontinue certain features at any time to maintain service quality, improve performance, and ensure a professional user experience.While paid users enjoy access to unlimited quiz and flashcard generation, heystudy implements reasonable technical limits to prevent abuse, spam, or excessive automated use. These safeguards ensure stable and fair access to the Service for all users and may include temporary rate limits or content-generation caps.2. EligibilityYou must be at least 18 years old (or the age of legal majority in your jurisdiction, if higher) to use the Service. By accessing or using the Service, you represent and warrant that:
  • You are of legal age to form a binding contract with heystudy; and
  • You have not been previously suspended or removed from the Service; and
  • Your use of the Service complies with all applicable laws and regulations.
If you are accessing the Service on behalf of a company, organization, or other legal entity, you represent that you have the authority to bind that entity to these Terms. In such cases, "you" and "your" refer to both you as an individual and the entity you represent.We reserve the right to refuse access to or use of the Service to any person or entity at our sole discretion, including where we reasonably believe that such use violates these Terms or could harm heystudy, its users, or third parties.3. Account RegistrationYou may browse and view the heystudy website and public content without creating an account. However, access to certain features, tools, and services within the platform requires registration.When you create an account, you must provide accurate, complete, and current information. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. Your account is personal to you and may not be sold, transferred, or shared with any other person or entity. If you believe your account has been accessed without authorization, you must notify us immediately.By registering, you agree that the information you provide will be used in accordance with our Privacy Policy and that heystudy may communicate with you regarding service updates, account issues, or changes to these Terms.4. Subscriptions and Payments4.1 Subscription PlansCertain features of the Service are available only through paid subscriptions (each, a "Subscription"). The details of available plans, including pricing, duration, and included features, are provided on our website or within the Service. By purchasing a Subscription, you agree to pay all fees and charges associated with your plan in accordance with these Terms and any applicable billing terms presented to you at the time of purchase.4.2 Billing and Payment ProcessingPayments are securely processed by Stripe, Inc. ("Stripe"), our third-party payment processor. By making a payment, you agree to comply with Stripe's Terms of Service and Privacy Policy. heystudy does not store your complete payment information (such as full credit card numbers); all sensitive payment details are managed by Stripe. You authorize heystudy and Stripe to charge your chosen payment method for all applicable fees on a recurring basis, depending on your selected Subscription plan.4.3 Renewals and CancellationsUnless otherwise stated, all Subscriptions automatically renew at the end of the applicable billing period for successive periods of equal length at the then-current rate. You may cancel your Subscription at any time through your account settings. Cancellations take effect at the end of the current billing cycle, and you will retain access to paid features until that time. Subscription fees are non-refundable, except as required by applicable law or explicitly stated otherwise by heystudy.4.4 Failed PaymentsIf payment is declined or cannot be processed, we may attempt to reprocess the charge. If payment remains unsuccessful, heystudy reserves the right to suspend or terminate your access to paid features until the outstanding balance is resolved.4.5 Price Changesheystudy may modify its pricing and fees from time to time. Any change to Subscription pricing will be communicated in advance, and new rates will apply beginning with your next billing cycle following the notice period. Continued use of the Service after a price change constitutes your agreement to the modified pricing.4.6 RefundsExcept where required by law, all payments are non-refundable and non-transferable. However, in exceptional cases (such as technical issues preventing use of the Service), we may, at our sole discretion, issue partial or full refunds. To request a refund, please contact our support team at support@heystudy.io within 14 days of the billing date.4.7 TaxesAll prices displayed on the Service are inclusive of applicable taxes, including VAT where required by law. heystudy is responsible for collecting and remitting such taxes under its VAT obligations within the European Union, including through the Union One-Stop Shop ("OSS") scheme where applicable.You will not be charged any additional taxes at checkout unless explicitly stated otherwise for your location.For customers outside the European Union, no VAT will be charged, but local taxes or duties (if any) may apply under your jurisdiction's laws.5. User ContentYou retain ownership of any notes, documents, images, or other materials you create or upload ("User Content"). By using the Service, you grant heystudy a limited, non-exclusive, worldwide license to store, process, and display your User Content solely to operate and provide the Service. We do not claim ownership of your content, and it remains private unless you choose to share it.6. Acceptable UseYou agree not to use the Service in any manner that could damage, disable, overburden, or impair the functionality or security of the platform or interfere with any other party's use of it. In particular, you must not use the Service:
  • For any unlawful, fraudulent, or unauthorized purpose, or in violation of any local, national, or international law or regulation.
  • To impersonate any person or entity, misrepresent your affiliation, or otherwise engage in deceptive or misleading behavior.
  • To stalk, harass, or otherwise harm any individual.
  • To upload, post, or share content that infringes intellectual property rights, violates privacy, or breaches confidentiality obligations.
  • To publicly reproduce, distribute, or display any part of the Service without authorization.
  • To interfere with, disrupt, or attempt to gain unauthorized access to servers, systems, or networks connected to the Service.
  • To harvest or collect user data, email addresses, or other contact information without consent.
  • To use automated scripts, bots, crawlers, or similar technologies to access, scrape, or collect data from the platform.
  • To create or promote fake reviews, spam, or misleading activity that may harm the Service or other users.
  • To circumvent any security or content-filtering systems used by heystudy.
  • To engage in excessive, automated, or abusive use of AI-based generation features beyond what is reasonably necessary for personal learning purposes. heystudy may apply temporary or permanent usage limits to maintain system integrity and service availability.
Violation of these rules constitutes a material breach of these Terms and may result in immediate suspension or termination of your account, as well as potential legal action if applicable.7. Intellectual PropertyAll trademarks, logos, designs, text, graphics, and underlying software that form part of the Service are the exclusive property of heystudy or its licensors and are protected by intellectual property laws. This includes the design, layout, functionality, and content of the platform, which may not be copied, modified, reproduced, distributed, or otherwise exploited without prior written authorization.You, as a user, retain ownership of your personal User Content — such as notes, documents, or materials you create — but you acknowledge that the platform, its software, and all related technology, features, and design elements remain the sole property of heystudy. Except for the limited license granted to you to access and use the Service under these Terms, no other rights or ownership interests are transferred to you.8. TerminationYou may delete your account at any time. We reserve the right, at our sole discretion, to suspend or terminate your account or restrict your access to the Service for any reason, including but not limited to violations of these Terms, suspected fraudulent or abusive activity, or behavior that could harm heystudy, its users, or third parties. We may also terminate accounts that remain inactive for extended periods or where continued use may pose a legal or security risk. Upon termination, your right to access the Service will cease immediately, and your data will be handled in accordance with our Privacy Policy.9. Disclaimer of WarrantiesThe Service is provided "as is" and "as available". We do not guarantee that the Service will be uninterrupted, secure, or error-free. Your use of the Service is at your own risk. Certain features of the Service, including AI-generated outputs such as quizzes or flashcards, are intended solely as educational assistance tools. You acknowledge and agree that these AI-generated materials may contain inaccuracies, omissions, or errors, and heystudy does not warrant the accuracy, reliability, or completeness of such content. Users should review all AI-generated content critically and should not rely on it as factual, definitive, or error-free.10. Limitation of LiabilityYou use the Service, site, and materials at your sole risk. To the maximum extent permitted by law, heystudy and its affiliates shall not be liable to you for any damages resulting from your displaying, copying, or downloading any materials to or from the platform or your use of our services. In no event shall heystudy or its affiliates be liable to you for any indirect, extraordinary, exemplary, punitive, special, incidental, or consequential damages, including without limitation loss of data, revenue, profits, business, or other economic advantage, however arising, even if we are aware of the possibility of such damages. heystudy shall not be responsible for any unauthorized copying, use, or distribution of user content by third parties.11. Changes to These TermsWe may modify these Terms from time to time. Updated versions will be posted on heystudy website, and the "Last updated" date will be revised.
